Terms and Conditions

The YO1 Longevity & Health Resorts General Terms and Conditions of Sale (“GTC”) apply to all reservations at YO1 Longevity & Health Resorts, regardless of the sales channel. The terms “you” or “your” refer to the YO1 Longevity & Health Resorts guest and any visitor to YO1.com. The term “our”, “we” or “us” refers to YO1 Longevity & Health Resorts.

1. Reservations and Rates

   1. Reservation. Your reservation at YO1 Longevity & Health Resorts is subject to your acceptance of the GTC, available at YO1.com. Your reservation at YO1 Longevity & Health Resorts is not valid until we have confirmed your reservation in writing, in the form of an email acknowledgement to you from YO1 Longevity & Health Resorts. Such email will summarize the bundled daily or multi-day packages reserved, the rates accepted by the guest, and your acknowledgement of the GTC, and contact information for YO1 Longevity & Health Resorts where the guest may submit a complaint.
   2. Group Reservation. In the case of a group reservation, the guest must negotiate a YO1 Longevity & Health Resorts group contract, and the terms of such contract or of any YO1 Longevity & Health Resorts reservation contract will take precedence over the terms of the GTC, in the event of a conflict between the contract and the GTC. A group reservation is defined as reservation by 10 or more rooms under the same legal entity.
   3. Deposit. One (1) night deposit for each room is due at time of booking to confirm your guaranteed reservation. For reservations confirmed from countries where local regulations prohibit guarantees to a credit card, payment by wire or check, for 100% of the total reservation, must be received by YO1 Longevity & Health Resorts. Your deposit may forfeit, and your reservation may cancel, if you arrive after Check-In Time without confirmation by YO1 Longevity & Health Resorts to cancel or modify your reservation.
   4. Age Requirement. Guests must be 18 years or older with photo identification to reserve a room.
   5. Minors. Minor children, age 16 and 17, may be included in your reservation, and are permitted to stay at YO1 Longevity & Health Resorts; note that such minors will require a parent or guardian to sign consent forms on their behalf, to participate in the therapy services at YO1 Longevity & Health Resorts.
   6. Non-Transferable. Any reservation is personal and cannot be transferred to a third party under any circumstances, whether free of charge or in return for payment, except as authorized in writing by YO1 Longevity & Health Resorts.
   7. Rates. Bundled daily or multi-day package (e.g., 3-day, 5-day, and 10-day) rates include room rental, scheduled therapy services and scheduled food and beverage services; but excludes Juice Bar service that is not part of your scheduled food and beverage services, and excludes services at the Tea Cafe. Rates are calculated, based upon check-in date, per day, and per multi-day package, and per day for add-on days to your selected multi-day package. All reservations, regardless of origin, are payable and confirmed in U.S. dollars, unless specifically indicated otherwise.
   8. Taxes and Service Charges. Applicable taxes and service charges, if applicable, will be added to your YO1 Longevity & Health Resorts bill, and refer to those taxes and service charges currently in effect. Taxes and service charges are subject to change without notice, according to local law.
   9. Administrative Charges.An administrative fee of 18% will be added to the invoice of A-La-Carte Wellness Services. Please note that this administrative charge is for administration and overhead costs, is not a gratuity or purported to be a gratuity and is not distributed as gratuities to any employee. If you wish to leave a gratuity, you may do so at your discretion.
   10. Administrative Charges for dining.A 10% administrative fee is charged by the dining room towards retail lunch/dinners.
   11. Incidentals Policy. YO1 Longevity & Health Resorts requires guests to provide a debit or credit card for payment upon arrival. We will authorize your card in the amount of 100 $USD per stay to cover incidental costs and taxes, which authorization will be released at checkout. Timing of such authorization release depends upon your financial institution; YO1 Longevity & Health Resorts is not responsible for any resulting fees or charges.
   12. Check-in and Check-out Time. Check-in time is from 3pm EST (“Check-In Time”) and check-out time is by 11am EST.
   13. Early Check-In. Rooms may not be available until after Check-In Time. Occupancy prior to Check-In Time on the date of the reservation cannot be confirmed unless YO1 Longevity & Health Resorts has availability and payment is received by YO1 Longevity & Health Resorts prior to arrival either by credit card accepted by YO1 Longevity & Health Resorts or a deposit by wire or check.
   14. Cancellation or Modification of Reservation. 100% of the entire stay will be charged if the cancellation is done within 7 days from the check-in date, starting 15th March 2022. A new deposit may be required for any modifications to your reservation, including the length of stay, check-in and check-out dates, and the number of guests or rooms, and may also incur a rate change and/or service fees; such modifications are subject to YO1 Longevity & Health Resorts's availability at the time the modification is requested.
       1. Reservations at YO1.com. You may cancel or modify your reservation at the reservations page at YO1.com, or email yo1info@yo1.com.
       2. Third-party Reservations. Reservations reserved on third-party Web sites including, and without limitation, expedia.com, hotwire.com, priceline.com, orbitz.com, booking.com, travelocity.com, etc., cannot be cancelled or modified at YO1.com, or by calling or emailing YO1 Longevity & Health Resorts. Please contact your original reservation source for modifications to these types of reservations.
       3. Room Only Bookings: 100% of the entire stay will be charged if the cancellation is done within 2 days from the check-in date.



2. Your Stay at YO1 Longevity & Health Resorts

   1. Privacy and Confidentiality.
      1. Guest Confidentiality. YO1 Longevity & Health Resorts is dedicated to protecting your privacy and safeguarding your personal information. We strive to create an experience that is responsive to our guests’ needs by using the information you entrust us with responsibly. As a general practice, we do not sell, rent, or give physical possession of your personal data to unaffiliated third parties outside of YO1 Longevity & Health Resorts. We recognize the importance of information security and is constantly reviewing and enhancing our technical and non-technical safeguards, policies and procedures. We are committed to respecting your privacy and adhering to the principles of applicable data protection and privacy laws. Our complete Privacy Policy is available at YO1.com.
      2. HIPAA Privacy Practices. We protect the privacy of your health information with our privacy practices, policies and training, and our secure electronic health record system. Our HIPAA Notice of Privacy Practices describes how YO1 Longevity & Health Resorts may use and disclose health information about you, to help care for you, and how you may access such health information.    2. No-Pets Policy. YO1 Longevity & Health Resorts has a no-pets policy anywhere on the property of YO1 Longevity & Health Resorts. Our no-pet policy does not apply to service animals, described in the Americans with Disabilities Act (ADA); however, you must notify YO1 Longevity & Health Resorts if you will arrive with a service animal, so that we can better accommodate your needs.
   3. No-Smoking and No-Drugs Policy. YO1 Longevity & Health Resorts has a no smoking, no tobacco use, and drug-free policy (recreational use of drugs, and other use of drugs prohibited by law) anywhere on the property of YO1 Longevity & Health Resorts. A minimum charge of $400 will be applied for smoking in a guest room.
   4. Guest Conduct. Any conduct contrary to accepted standards of behavior and public order will result in our asking you to leave YO1 Longevity & Health Resorts with no compensation and/or refund if a payment has already been made. If no payment has been made, you will have to pay the daily rate for any whole or part of a day, already stayed before leaving YO1 Longevity & Health Resorts.
   5. Wi-Fi Access. If you are provided with or utilize wi-fi access at YO1 Longevity & Health Resorts, you acknowledge and agree that such access is for personal use and you agree not to use such access in a manner prohibited by any federal or state law or regulation, including, but not limited to the transmission of any copyrighted material, material protected by a trade secret or material or messages that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable in any manner or nature or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation.
      1. You assume responsibility for any content that you access on the Internet or otherwise through such wi-fi access, at YO1 Longevity & Health Resorts.
      2. We are under no obligation to monitor such w-fi access, but we may do so from time to time and we may disclose information regarding guest’s use of such wi-fi for any reason and at our sole discretion to satisfy applicable laws, regulations, governmental requests. We agree to comply with the terms of our Privacy Policy, available at YO1.com, as it may be amended from time to time.
   6. Informed Consent and Waiver.YOU ACKNOWLEDGE THAT NO ASSURANCE OR GUARANTEE HAS BEEN PROVIDED TO YOU BY YO1 Longevity & Health Resorts AS A RESULT OF THE THERAPY SERVICES OFFERED AT YO1 Longevity & Health Resorts. YOU ARE AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO PARTICIPATING IN THE THERAPY SERVICES AT YO1 Longevity & Health Resorts, AND ACKNOWLEDGE THAT THIS IS A CONSENT, RELEASE OF LIABILITY AND A WAIVER OF YOUR LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, OR ANY OTHER LIABILITY. IT IS YOUR INTENTION TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND ANY OTHER LIABILITY UPON YOURSELF, TO THE EXCLUSION OF YO1 Longevity & Health Resorts, ITS PARENT COMPANIES AND SUBSIDIARIES, AND ITS EMPLOYEES (“YO1 WELLNESS RESORT AND SPA ENTITIES”), AND TO EXEMPT YO1 Longevity & Health Resorts ENTITIES FROM ALL LIABILITY.

3. YO1.com

   1. General. You may only use the reservation services of YO1.com if you are at least 18 years of age and can form legally binding contracts under applicable law. The reservation services of YO1.com are not intended for and should not be used by minors. In addition to any other rights or remedies that may be available to YO1 Longevity & Health Resorts, we may, without any liability whatsoever, in our sole discretion, terminate or restrict your access or use of YO1.com at any time and without notice.
   2. Accounts / Passwords. You are responsible for maintaining the secrecy of your passwords, log-in, and account information. You will be financially accountable for all uses of YO1.com by you and/or by anyone using your account information.
   3. Reservations on YO1.com. You may only use YO1.com to make legitimate reservations or purchases for yourself or an individual for whom you are authorized in advance to act. Unless you have obtained prior written permission from YO1 Longevity & Health Resorts, you may not use YO1.com to make reservations or purchases for other purposes, including without limitation for purposes of reselling rooms or reservations, posting, marketing, advertising, or otherwise distributing rooms, reservations, or availability (including without limitation on third-party web sites), making false, fraudulent, or speculative reservations, reserving rooms in anticipation of demand, or making reservations for commercial purposes (such as reselling rooms). Reservations made in violation of the GTC may be cancelled without notice at our sole discretion. YO1 Longevity & Health Resorts further reserves the right to cancel reservations without notice that are transferred in violation of the GTC.
   4. Credit Card Information. The storage of credit card information on YO1.com is entirely optional. It is not required to use YO1.com. Saving credit card information may help expedite your reservation process in the future. You will be solely responsible for updating any credit card information that you provide, and such information may only be maintained until the expiration date of the credit card. You acknowledge that YO1 Longevity & Health Resorts may communicate this information to facilitate reservations or as requested by you, including through applications on any mobile devices that you utilize that provide YO1 Longevity & Health Resorts with your account information or if you have established a link with such devices.
   5. Errors or Mistakes on YO1.com. YO1.com may contain technical inaccuracies and typographical or other, including without limitation rates, fees, or availability applicable to your transaction. YO1 Longevity & Health Resorts assumes no responsibility or liability for such errors, inaccuracies, or omissions. YO1 Longevity & Health Resorts will have the right not to honor reservations or information affected by such errors, inaccuracies, or omissions. YO1 Longevity & Health Resorts will have the right to make changes, corrections, cancellations, and/or improvements to such information or reservations based on such information, at any time, including after confirmation of a reservation.
   6. Promotional Information. YO1.com may display or provide information regarding specific programs, offers, or promotions (“Promotional Offers”). Any such Promotional Offer is subject to its specific terms, conditions and restrictions. Please refer to and read carefully the terms, conditions and restrictions of each Promotional Offer. YO1 Longevity & Health Resorts reserves the right to alter or withdraw any Promotional Offer at any time without notice. Each Promotional Offer is void where prohibited by law.
   7. Prohibited Uses. Any commercial use of YO1.com is expressly prohibited unless you have obtained prior written consent from YO1 Longevity & Health Resorts. You may not use YO1.com to post or transmit any unlawful, infringing, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law, or for any other purpose that is unlawful or prohibited by the GTC. You agree that you will not (a) interfere with or disrupt YO1.com, (b) use, place, or distribute any viruses, worms, time bombs, and/or other computer programming routines that damage, intercept, disrupt, or harm (or are intended to do any of the preceding) YO1.com, including the underlying software, hardware, systems, and any users of YO1.com or their devices, (c) use or attempt to use any robot, spider, automatic device, or automatic or manual process to monitor or copy YO1.com without YO1 Wellness Resort and Spa’s prior express written consent, or (d) use any device, software, or other instruments to monitor, copy, interfere with, or attempt to interfere with YO1.com, its content, or its operation without YO1 Wellness Resort and Spa’s prior express written consent.
   8. Privacy and Confidentiality. Your submission of information on YO1.com to make a reservation or utilize any other services made available to you on YO1.com is subject to YO1 Wellness Resort and Spa’s Privacy Policy, available at YO1.com, which is hereby incorporated into the GTC. Any communications such as searches, questions, comments, suggestions, requests and similar communications submitted by you to YO1 Longevity & Health Resorts are not confidential communications, and YO1 Longevity & Health Resorts will be free to use, reproduce, publish, distribute, and disclose such communications. We are under no obligation to protect such communications from disclosure. We may use, reproduce, publish, distribute, and disclose such communications to others without limitation and without any obligations to you. We are also free to use for any purpose whatsoever any ideas, concept, content, techniques, or know-how in such communications without limitation and without any obligations to you.
   9. Browsing Habits. YO1.com may tailor information, offers, and other content based on your browsing habits on YO1.com or your geographic location.
   10. Links. YO1.com may contain links to other Web sites on the Internet and certain actions on YO1.com may result in specific advertising from third parties, including information that may be displayed in other windows or in third party sites. YO1 Longevity & Health Resorts provides these links solely as a convenience to you. The inclusion of these links in no way indicates our endorsement, support, or approval of such sites, such site’s content, products, or services, or the operators of any such site. We undertake no obligation to review or monitor any sites linked to or from YO1.com. Your use of any such site is at your own risk and subject to the terms and conditions of such sites. We are not responsible for the content, products, services, or practices of third party sites. In addition, you agree not to link your site or any other third-party site to YO1.com without our express prior written consent.
   11. Miscommunications / Lost Transactions.YO1 Longevity & Health Resorts is not responsible for communication failures, errors, difficulties, or other malfunctions or lost, stolen, or misdirected transactions, transmissions, messages, or entries on or in connection with YO1.com. We are not responsible for any incorrect information associated with any transaction or transmission on or to YO1.com regardless of whether such incident is the result of user error, system error, or human error.
   12. Availability. YO1.com is available to anyone with Internet access. However, YO1.com may not be continuously available due to maintenance or repairs or due to computer or mobile device problems or crashes, disruption in Internet service or other unforeseen circumstances. The content of YO1.com, including advertising content, is intended for use and display only where its use and display are permissible in accordance with applicable laws and regulations. Each product or service is void where prohibited by law.
   13. Cookies on YO1.com. YO1.com uses various types of cookies to provide certain functionality. A cookie is a small text file that contains small amounts of information that are downloaded to your computer or mobile device when visiting a web site. These cookies are then sent back to the originating web site when you visit that site again or to another site that recognizes that cookie. You can adjust the settings in your browser to restrict or block cookies that are set by YO1.com (or any other site on the Internet). Your browser may include information on how to adjust your settings. Or you may visit www.allaboutcookies.org to obtain comprehensive general information about cookies and how to adjust the cookie settings on various browsers.
   14. Intellectual Property. Unless expressly stated otherwise, the content included on YO1.com, including but not limited to text, software, photographs, images, graphics, illustrations, artwork, video, music, sound, and names, logos, trademarks and service marks, are the property of YO1 Longevity & Health Resorts, its parents, or subsidiaries, or its licensors or suppliers. This content is protected by copyright, trademark and other laws. No right, title, or interest to the content is granted by your use of YO1.com, other than a right to review the content using a conventional Internet browser to conduct ordinary web browsing. All other uses, including making copies of any content on YO1.com, are strictly prohibited. You may not modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material for any purpose other than personal, non-commercial use (or legitimate activities of a travel agent or travel professional) without YO1 Wellness Resort and Spa’s written permission. Except for non-commercial individual private use, the downloading, reproduction, or retransmission of YO1.com (or any part of its content) is strictly prohibited.

4. Additional Terms

   1. Limitation of Liability.
      1. NEITHER YO1 Longevity & Health Resorts NOR ANY YO1 Longevity & Health Resorts PARENT NOR ANY SUBSIDIARY, AFFILIATE, AGENT, REPRESENTATIVE OR LICENSOR WILL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, YO1.COM, OR ANY MATERIALS, OPINIONS, RECOMMENDATIONS OR THERAPIES OF YO1 Longevity & Health Resorts OR YO1.COM.
      2. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF YO1 Longevity & Health Resorts HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
      3. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, YO1 WELLNESS RESORT AND SPA’S LIABILITY IN SUCH JURISDICTIONS WILL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
      4. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST YO1 Longevity & Health Resorts, ITS PARENT, AND ITS SUBSIDIARIES, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF YOUR USE OF ANY MATERIALS, OPINIONS, RECOMMENDATIONS OR THERAPIES OF YO1 Longevity & Health Resorts OR YO1.COM.
   2. Governing Law and Choice of Forum. YO1.com is controlled and operated by YO1 Longevity & Health Resorts from its office within the State of New York, USA. YO1 Longevity & Health Resorts makes no representation that the content or materials on YO1.com are appropriate or available for use in other locations. YO1 Longevity & Health Resorts is doing business with you in the State of New York. The GTC and any dispute arising out of or related to the GTC will be governed in all respects by and construed and enforced in accordance with the laws of the State of New York, USA, without regard to its conflicts of law principles. Exclusive jurisdiction over any claim or cause of action arising out of the GTC will be in state or federal courts located in or near Monticello, NY, USA. You further agree to submit to the exercise of personal jurisdiction of such courts to litigate any such claim or action.
   3. Severability. If any part of the GTC is unenforceable, the unenforceable part will be construed to reflect, as nearly as possible, the original intentions of the parties. All other provisions of the GTC will remain in full force and effect.
   4. No Waiver. YO1 Wellness Resort and Spa’s failure to insist upon or enforce strict performance of any provision of the GTC will not constitute a waiver of such provision. Neither a course of dealing or conduct between you and us nor any trade practices will be deemed to modify the GTC.
